Welcome to Tekits! The terms "we", "us", "our", and "Tekits" refer to Tekits Innovations Private Limited, an authorized distributor of Dareu products in India.

Tekits operates this store and website, including all related information, content, features, tools, products and services (the "Services"). Tekits is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service ("Terms"), together with our Privacy Policy, Return & Replacement Policy, and Shipping Policy, form the complete agreement between you and us.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and all related policies. If you do not agree, you should not use our Services.

By using our Services, you represent that:

All products sold are genuine Dareu products sourced from the manufacturer and distributed according to our authorization agreement.

SECTION 3: OUR PRODUCTS

Product Accuracy

We make every effort to provide accurate product representations. However:

  • Colors/appearance may vary based on device settings
  • We do not warrant that product appearance exactly matches on-screen depiction
  • We do not warrant products will meet your specific expectations
  • Product descriptions are subject to change without notice
  • We reserve the right to discontinue any product at any time
  • Quantities available may be limited by region or jurisdiction

Country of Origin

All Dareu products are manufactured in China and imported by Tekits Innovations Private Limited as an authorized distributor for India.

SECTION 4: ORDERS

Order Placement & Acceptance

When you place an order, you are making an offer to purchase. We reserve the right to:

  • Accept or decline your order for any reason
  • Cancel orders if information is inaccurate
  • Limit quantities to any person or region

Important: Your order is NOT accepted until we send you an acceptance confirmation email.

We must receive and process your payment before your order is accepted.

Order Cancellation

  • Within 12 hours of placement (before processing): You may request cancellation
  • After processing has begun: Cancellation not possible; use Return & Replacement Policy

You represent and warrant that:

  • Your purchases are for personal/household use only
  • Not for commercial resale or export
  • You have authority to make the purchase

SECTION 5: PRICES AND BILLING

Pricing Terms

  • Prices, discounts, and promotions are subject to change without notice
  • Price charged is the price in effect at time of order placement
  • Final price confirmed in order confirmation email
  • Taxes and shipping are calculated and displayed before checkout
  • Posted prices do not include taxes unless expressly stated

SECTION 6: SHIPPING AND DELIVERY

Delivery Timeline & Limitations

  • Processing time: 1-2 business days (Mon-Fri, 9 AM-6 PM IST)
  • Standard delivery: 5-7 business days (estimates, not guarantees)
  • Express delivery: 2-3 business days (additional cost)
  • Premium/Overnight: 1-2 business days in select cities (additional cost)

Important Disclaimers

We are NOT liable for:

  • Shipping delays due to courier, weather, or circumstances beyond our control
  • Delays caused by address issues or government restrictions
  • Delivery failures not due to our actions
  • Force majeure events (natural disasters, strikes, lockdowns, etc.)

Delivery Address

  • Provide complete, accurate delivery addresses
  • No delivery to P.O. boxes
  • Provide contact phone number for courier communication
  • You are responsible for address accuracy
  • Courier may return package if address is invalid/inaccessible

Order Tracking

  • Tracking information provided via email and Shopify account
  • Updates may lag by 4-6 hours
  • Real-time tracking available through courier's website
  • We provide tracking for transparency, not as guarantee of delivery

Lost or Undelivered Orders

  • Orders undelivered after 12 days are investigated
  • We file claims with courier on your behalf
  • Courier claim approval is not guaranteed
  • If claim approved: Replacement or refund offered
  • If claim denied: Tekits liability is limited (see Limitations section)
  • Refunds issued after final determination (7-10 days)

SECTION 7: WARRANTY DISCLAIMER

Dareu Manufacturer Warranty (6 Months)

All Dareu products include a limited 6-month manufacturer warranty covering:

  • Manufacturing defects in materials and workmanship
  • Hardware malfunctions due to manufacturing

Warranty EXCLUDES:

  • Physical damage, drops, or misuse
  • Water/liquid damage
  • Wear and tear
  • Cosmetic damage
  • Unauthorized repairs or modifications
  • Normal use degradation
  • Issues beyond 6 months from purchase date

Our Role as Distributor

Important: Tekits is a distributor, NOT the manufacturer.

  • Dareu is the actual manufacturer and bears ultimate responsibility
  • We facilitate warranty claims on your behalf
  • We assess whether issues are manufacturing defects or user-caused
  • Dareu's warranty is the primary warranty available

7-Day Replacement (Non-Defective Items)

For unopened, unused items within 7 days of delivery:

  • Replacement offered (NOT refund)
  • Item must be in original, unopened packaging
  • All original seals and accessories included
  • Subject to inspection and approval

DISCLAIMER OF ALL OTHER WARRANTIES

EXCEPT AS EXPRESSLY STATED ABOVE, THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

We do NOT warrant that:

  • Products will be error-free or perform perfectly
  • Products will meet your specific needs or expectations
  • Products are compatible with your devices or setup
  • Services will be uninterrupted, timely, or secure
  • Any defects will be corrected
  • Products won't fail from normal use

Some jurisdictions do not allow limitation of implied warranties, so the above disclaimer may not fully apply to you.

SECTION 8: INTELLECTUAL PROPERTY

Our Ownership

Our Services, including trademarks, brands, text, images, graphics, product reviews, video, audio, design, and selection, are owned by Tekits or its licensors and protected by intellectual property laws.

Your Limited Use License

These Terms grant you a limited, non-exclusive license to use the Services for personal, non-commercial purposes only.

You may NOT:

  • Tekits names, logos, and product names are trademarks of Tekits
  • Dareu names, logos, and product names are trademarks of Dareu Electronics Audio Co., Ltd
  • All other names, logos, and product names are trademarks of their respective owners
  • You may NOT use these trademarks without prior written permission

SECTION 9: OPTIONAL TOOLS

Third-party tools may be provided as part of the Services. We:

  • Do not monitor, control, or endorse these tools
  • Provide access "as is" without warranties
  • Are NOT liable for your use of optional tools

Use of optional tools is entirely at your own risk.

Our Services may contain links to third-party websites. We:

  • Are not responsible for examining third-party content
  • Do not guarantee accuracy or security of third-party sites
  • Are not liable for any harm from accessing third-party sites

SECTION 11: RELATIONSHIP WITH SHOPIFY

Tekits is powered by Shopify, which enables us to provide the Services. However:

All purchases are made directly with Tekits Innovations Private Limited, not Shopify.

You acknowledge and agree that:

  • Shopify is not responsible for any aspect of our sales
  • Shopify is not responsible for injury, damage, or loss from products
  • You expressly release Shopify and its affiliates from all claims arising from your transactions with us

TO THE FULLEST EXTENT PROVIDED BY LAW, NEITHER TEKITS, SHOPIFY, NOR ANY OF OUR RESPECTIVE PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR SERVICE PROVIDERS SHALL BE LIABLE FOR:

  • Any direct, indirect, incidental, punitive, special, or consequential damages
  • Lost profits, lost revenue, lost savings, loss of data, or replacement costs
  • Any injury, loss, claim, or damages arising from:
    • Your use of the Services
    • Any products purchased
    • Any errors or omissions in content
    • Any loss or damage from the Services
    • Any other cause related to your use

THIS APPLIES EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Types of Damages NOT Covered

  • Loss of use, time, or goodwill

  • Replacement cost of goods or services

Your Exclusive Remedy

If you are dissatisfied with the Services or any product, your exclusive remedy is:

  • Replacement under our Return & Replacement Policy
  • Refund of the purchase price (if applicable per policy)
  • No other remedies available

SECTION 18: INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Tekits, Shopify, and our respective affiliates, officers, directors, employees, agents, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, arising from:

  1. Your breach of these Terms
  2. Your violation of any law or rights of third parties
  3. Your use of the Services
  4. Your violation of our Return & Replacement Policy
  5. Your shipping address errors or delivery refusals

We will notify you of any indemnifiable claim. We may control defense and settlement at your expense. You must cooperate in defense of indemnified claims.

SECTION 19: SEVERABILITY

If any provision is determined to be unlawful or unenforceable, it shall be severed. Such determination will not affect the validity or enforceability of remaining provisions. We will enforce provisions to the maximum extent permitted by law.

SECTION 20: WAIVER; ENTIRE AGREEMENT

Failure to enforce any right does not constitute waiver of that right.

These Terms and all related policies (Privacy Policy, Return & Replacement Policy, Shipping Policy) constitute the entire agreement between you and us. These Terms supersede all prior agreements, communications, and proposals.

SECTION 21: ASSIGNMENT

  • You may NOT delegate, transfer, or assign this Agreement or your rights/obligations without our written consent
  • Any attempted assignment is void
  • We may transfer, assign, or delegate without notice

SECTION 22: GOVERNING LAW AND JURISDICTION

These Terms are governed by the laws of India, specifically the state of Kerala.

You and Tekits consent to:

  • Exclusive jurisdiction of courts in Ernakulam, Kerala
  • Exclusive venue in Ernakulam district courts
  • All disputes subject to Indian legal system
  • Application of Consumer Protection Act, 2019

SECTION 23: DISPUTE RESOLUTION

Consumer Protection Act 2019

This agreement is subject to the Consumer Protection Act, 2019. If you believe we have violated your consumer rights:

  2. Local Consumer Protection Authority: File complaint with district/state commission
  3. National Consumer Helpline: 1800-11-4000 (toll-free)

Consumer complaints may proceed independently of this Terms agreement.

SECTION 24: CHANGES TO TERMS

We reserve the right to modify these Terms at any time. Changes are effective upon posting to our website. Your continued use constitutes acceptance of modified Terms.

Material changes will be notified via email if you have provided an email address.
